Currently PDE is in the final stages of the solicitation for the PASA services. If we do not extend this existing contract, there will be no contract in place for the Spring 2022 testing session (Oct 2021-June 2022). State assessments of students with significant, cognitive disabilities are mandated by the federal Every Student Succeeds Act (ESSA) and the Individuals with Disabilities Education Act (IDEA). In order to comply with federal guidance, the Pennsylvania Department of Education has extended the testing window from the Spring of 2021, to the Fall of 2021. This testing window extension, plus the implementation of the Spring 2022 testing window necessitates the extension of the current Emergency Procurement (EP). The long term contract is anticipated to begin July 1, 2022-June 30, 2027. This EP is to prevent a lapse in services and a contract is currently being established for the long term services. PDE may terminate the EP prior to the end date, which is slated to end on June 30, 2022, to allow for the new contract to begin sooner.

Justification for Extension:
|
Without the extension, the Pennsylvania Department of Education will not be able to fulfill its federal obligations of state-wide assessments as there is not contact in place for PASA for the Spring of 2022.

Result, if not Approved:
|
If PDE does not provide an alternate assessment for students with significant, cognitive disabilities for LEAs to administer in Spring of 2022, the United States Department of Education will levy significant sanctions against PDE, including withholding of federal funds for not meeting its state educational agency obligations.
